By using MigraineTracker, you agree to the following terms. Please read them carefully.

Who We Are

MigraineTracker is a trading name of SME Web Designs Ltd, a company registered in England and Wales (company number 16914352), registered office 82a James Carter Road, Mildenhall, Bury St. Edmunds, IP28 7DE. These terms are an agreement between you and SME Web Designs Ltd ("we", "us").

MigraineTracker is not a medical device.

The content and tools provided by this application are for informational and tracking purposes only. They are not intended to be a substitute for professional medical advice, diagnosis, or treatment. Always seek the advice of your physician or other qualified health provider with any questions you may have regarding a medical condition. Never disregard professional medical advice or delay in seeking it because of something you have read on this app.

Subscriptions & Payments

  • BillingPremium features (currently PDF reports, longer-range Stats & Trends, and CSV export and backups) are billed on a subscription basis ("Subscription"). You will be billed in advance on a recurring and periodic basis (monthly or annually). Subscriptions are bought and managed in the web app, not through the App Store or Google Play.
  • CancellationYou may cancel your Subscription at any time in the web app under Profile → Subscription → Manage Subscription & Billing. Your access to Premium features will continue until the end of your current billing period.
  • RefundsPayments are non-refundable, except as required by law or as described under Account Security & Termination below.

Account Security & Termination

You are responsible for safeguarding the password that you use to access the Service. You agree not to disclose your password to any third party. You must notify us immediately upon becoming aware of any breach of security or unauthorized use of your account.

We may suspend or close your account immediately if you seriously or repeatedly breach these Terms, if we reasonably suspect fraud or misuse of the Service, or if we are required to by law.

In any other case, we will give you at least 30 days' notice by email before closing your account or discontinuing the Service, so you have time to download your data. If you have paid for a Subscription period that you will no longer be able to use, we will refund the unused part.

You can close your account at any time from the "Danger Zone" in your Profile. If you have a Subscription, cancel it first under Manage Subscription & Billing.

Limitation of Liability

In no event shall SME Web Designs Ltd, nor its directors or developers, be liable for any indirect, incidental, special, consequential or punitive damages, including without limitation, loss of profits, data, use, goodwill, or other intangible losses, resulting from (i) your access to or use of or inability to access or use the Service; (ii) any conduct or content of any third party on the Service; (iii) any content obtained from the Service; and (iv) unauthorized access, use or alteration of your transmissions or content, whether based on warranty, contract, tort (including negligence) or any other legal theory, whether or not we have been informed of the possibility of such damage.

Nothing in these Terms limits or excludes our liability for death or personal injury caused by our negligence, for fraud or fraudulent misrepresentation, or for anything else that cannot be limited or excluded by law. Nothing in these Terms affects your statutory rights as a consumer.

Governing Law

These terms are governed by the laws of England and Wales. If you live elsewhere in the UK, you may also bring proceedings in the courts of your home nation.
